Sibiu<br \/>\nau fost avute \u00een vedere prevederile Legii nr.7\/2004 privind Codul de conduit\u0103<br \/>\nal func\u0163ionarilor publici, republicat\u0103, precum \u015fi prevederile Legii<br \/>\nnr.477\/2004<span>\u00a0 <\/span>Codul de conduit\u0103<span>\u00a0 <\/span>a personalului contractual din autorit\u0103\u0163ile<br \/>\n\u015fi institu\u0163iile publice.<\/span><\/p>\n<p profesional\u0103 reglementeaz\u00e3<br \/>\nnormele de etica, conduit\u00e3 profesional\u00e3 \u015fi integritate a func\u0163ionarilor publici<br \/>\n\u015fi personalului contractual din cadrul Agentiei Judetene pentru Ocuparea Fortei<br \/>\nde Munca Sibiu \u015fi este denumit \u00een continuare <i>Codul de etic\u0103<\/i>.<\/span><\/span><\/p>\n<p class=\"MsoNormal\" style=\"margin-left:13.5pt;text-align:justify;background:white\"><span><b><span lang=\"RO\">Art.2<\/span><\/b><\/span><span><span lang=\"RO\"> Normele de conduit\u00e3 profesional\u00e3 prev\u00e3zute de prezentul cod<br \/>\nde etic\u0103 sunt obligatorii pentru functionarii publici \u015fi personalul contractual<br \/>\ndin cadrul AJOFM Sibiu.<\/span><\/span><\/p>\n<p class=\"MsoNormal\" style=\"margin-left:31.5pt;text-align:justify;background:white\"><span><span lang=\"RO\"><br \/>\n\u00a0<b>Obiective<\/b><\/span><\/span><\/p>\n<p class=\"MsoNormal\" style=\"text-align:justify;background:white\"><span><span lang=\"RO\">\u00a0\u00a0\u00a0<\/span><\/span><span><span lang=\"RO\"><br \/>\n<b>Art.3<\/b>\u00a0\u00a0Obiectivele<br \/>\nprezentului Cod de etic\u0103 urm\u00e3resc asigurarea calit\u00e3\u0163ii serviciului public, o<br \/>\nbun\u00e3 administrare \u00een realizarea interesului public, precum eliminarea<br \/>\nbirocra\u0163iei \u015fi a faptelor de corup\u0163ie din administra\u0163ia public\u0103, prin:<br \/>\n\u00a0 \u00a0\u00a0a) reglementarea normelor de conduit\u00e3 profesional\u00e3 necesare<br \/>\nrealiz\u00e3rii unor raporturi sociale \u015fi profesionale corespunz\u00e3toare cre\u00e3rii \u015fi<br \/>\nmen\u0163inerii la nivel \u00eenalt a prestigiului agentiei de ocupare si personalului<br \/>\nacestuia;<br \/>\n\u00a0 \u00a0\u00a0b) informarea publicului cu privire la conduita profesional\u00e3<br \/>\nla care este \u00eendrept\u00e3\u0163it s\u00e3 se a\u015ftepte din partea func\u0163ionarilor publici din<br \/>\ncadrul agentiei de ocupare;<br \/>\n\u00a0 \u00a0\u00a0c) crearea unui climat de \u00eencredere \u015fi respect reciproc \u00eentre<br \/>\ncet\u00e3\u0163eni \u015fi func\u0163ionarii publici \u015fi personalul contractual din cadrul agentiei<br \/>\nde ocupare, pe de o parte, \u015fi \u00eentre cet\u00e3\u0163eni \u015fi autoritatile administra\u0163iei<br \/>\npublice, pe de alt\u00e3 parte.<\/span><\/span><\/p>\n<p class=\"MsoNormal\" style=\"text-align:justify;background:white\"><span><span lang=\"RO\">\u00a0 \u00a0<\/span><\/span><\/p>\n<p class=\"MsoNormal\" style=\"background:white\"><span><b><span lang=\"RO\">Principii generale<\/span><\/b><\/span><\/p>\n<p class=\"MsoNormal\" style=\"background:white\"><span><span lang=\"RO\">\u00a0<\/span><\/span><\/p>\n<p class=\"MsoNormal\" style=\"text-align:justify;background:white\"><span><b><span lang=\"RO\">Art.4<\/span><\/b><\/span><span><span lang=\"RO\">\u00a0Principiile care guverneaz\u00e3 conduita profesional\u00e3 a<br \/>\nfunc\u0163ionarilor publici \u015fi personalului contractual din cadrul AJOFM Sibiu sunt cele<br \/>\nprev\u0103zute la art.3 din Legea nr.7\/2004 privind Codul de conduit\u0103 a<br \/>\nfunc\u0163ionarilor publici, cu modific\u0103rile \u015fi complet\u0103rile ulterioare \u015fi la art.3<br \/>\ndin Legea nr.477\/2004 privind Codul de conduit\u0103 a personalului contractual din<br \/>\nautoritatile \u015fi institu\u0163iile publice, respectiv urm\u00e3toarele:<\/span><\/span><\/p>\n<p class=\"MsoNormal\" style=\"text-align:justify;background:white\"><span><span lang=\"RO\">\u00a0 \u00a0\u00a0a) <i>suprema\u0163ia Constitu\u0163iei \u015fi a legii<\/i>,<br \/>\nprincipiu conform c\u00e3ruia func\u0163ionarii publici au \u00eendatorirea de a respecta<br \/>\nConstitu\u0163ia \u015fi legile \u0163\u00e3rii;<br \/>\n\u00a0 \u00a0\u00a0b) <i>prioritatea<br \/>\ninteresului<\/i> <i>public<\/i>, principiu<br \/>\nconform c\u00e3ruia func\u0163ionarii publici din cadrul agentiei de ocupare au<br \/>\n\u00eendatorirea de a considera interesul public mai presus dec\u00e2t interesul<br \/>\npersonal, \u00een exercitarea func\u0163iei publice;<br \/>\n\u00a0 \u00a0\u00a0c<i>) asigurarea<br \/>\negalit\u00e3\u0163ii de tratament a cet\u00e3\u0163enilor<\/i> \u00een aplica acela\u015fi regim juridic \u00een<br \/>\nsitua\u0163ii identice sau similare;<br \/>\n\u00a0 \u00a0\u00a0d) <i>profesionalismul<\/i>,<br \/>\nprincipiu conform c\u00e3ruia func\u0163ionarii publici din cadrul agentiei de ocupare au<br \/>\nobliga\u0163ia de a \u00eendeplini atribu\u0163iile de serviciu cu responsabilitate,<br \/>\ncompeten\u0163\u00e3, eficien\u0163\u00e3, corectitudine \u015fi con\u015ftiinciozitate;<br \/>\n\u00a0 \u00a0\u00a0e) <i>impar\u0163ialitatea \u015fi<br \/>\nindependen\u0163a<\/i>, principiu conform c\u00e3ruia func\u0163ionarii publici din cadrul<br \/>\nagentiei de ocupare sunt obliga\u0163i s\u00e3 aib\u00e3 o atitudine obiectiv\u00e3, neutr\u00e3 fa\u0163\u00e3 de<br \/>\norice interes politic, economic, religios sau de alt\u00e3 natur\u00e3, \u00een exercitarea<br \/>\nfunc\u0163iei publice;<br \/>\n\u00a0 \u00a0\u00a0f) <i>integritatea moral\u00e3<\/i>,<br \/>\nprincipiu conform c\u00e3ruia func\u0163ionarilor publici din cadrul agentiei de ocupare le<br \/>\neste interzis s\u00e3 solicite sau s\u00e3 accepte, direct ori indirect, pentru ei sau<br \/>\npentru al\u0163ii, vreun avantaj ori beneficiu \u00een considerarea func\u0163iei publice pe<br \/>\ncare o de\u0163in, sau s\u00e3 abuzeze \u00een vreun fel de aceast\u00e3 func\u0163ie;<br \/>\n\u00a0 \u00a0\u00a0g) <i>libertatea g\u00e2ndirii<br \/>\n\u015fi a exprim\u00e3rii<\/i>, principiu conform c\u00e3ruia func\u0163ionarii publici din cadrul<br \/>\nagentiei de ocupare pot s\u00e3-\u015fi exprime \u015fi s\u00e3-\u015fi fundamenteze opiniile, cu<br \/>\nrespectarea ordinii de drept \u015fi a bunelor moravuri;<br \/>\n\u00a0 \u00a0\u00a0h) <i>cinstea \u015fi<br \/>\ncorectitudinea<\/i>, principiu conform c\u00e3ruia \u00een exercitarea func\u0163iei publice \u015fi<br \/>\n\u00een \u00eendeplinirea atribu\u0163iilor de serviciu func\u0163ionarii publici din cadrul<br \/>\nagentiei de ocupare trebuie s\u00e3 fie de bun\u00e3-credin\u0163\u00e3;<br \/>\n\u00a0 \u00a0\u00a0i) <i>deschiderea \u015fi<br \/>\ntransparen\u0163a<\/i>, principiu conform c\u00e3ruia activit\u00e3\u0163ile desf\u00e3\u015furate de<br \/>\nfunc\u0163ionarii publici din cadrul agentiei de ocupare \u00een exercitarea func\u0163iei lor<br \/>\nsunt publice \u015fi pot fi supuse monitoriz\u00e3rii cet\u00e3\u0163enilor.<\/span><\/span><\/p>\n<p class=\"MsoNormal\" style=\"text-align:justify;background:white\"><span><span lang=\"RO\">\u00a0 \u00a0\u00a0<\/span><\/span><\/p>\n<p class=\"MsoNormal\" style=\"text-align:justify;background:white\"><span><b><span lang=\"RO\">Termeni<\/span><\/b><\/span><\/p>\n<p class=\"MsoNormal\" style=\"text-align:justify;background:white\"><span><span lang=\"RO\">\u00a0<\/span><\/span><\/p>\n<p class=\"MsoNormal\" style=\"text-align:justify;background:white\"><span><b><span lang=\"RO\">Art.5 <\/span><\/b><\/span><span><span lang=\"RO\">\u00cen \u00een\u0163elesul<br \/>\nprezentului Cod de etic\u0103, urm\u0103torii termeni se definesc astfel:<\/span><span lang=\"RO\"><br \/>\n<\/span><\/span><span><span lang=\"RO\">\u2003\u2003a) <b>func\u0163ionar<br \/>\npublic<\/b> &#8211; persoana numit\u0103 \u00eentr-o func\u0163ie public\u0103 \u00een condi\u0163iile <\/span><\/span><a name=\"REF3\"><\/a><span><span class=\"panchor2\"><span style=\"font-size:11.0pt\" lang=\"RO\">Legii nr. 188\/1999<\/span><\/span><\/span><span><span lang=\"RO\"> privind Statutul func\u0163ionarilor publici, republicat\u0103<\/span><span lang=\"RO\"><br \/>\n<\/span><\/span><span><span lang=\"RO\">\u2003\u2003b) <b>func\u0163ie<br \/>\npublic\u0103<\/b> &#8211; ansamblul atribu\u0163iilor \u015fi responsabilit\u0103\u0163ilor stabilite de<br \/>\nautoritatea sau institu\u0163ia public\u0103, \u00een temeiul legii, \u00een scopul realiz\u0103rii<br \/>\ncompeten\u0163elor sale;<\/span><\/span><\/p>\n<p class=\"MsoNormal\" style=\"text-align:justify;text-indent:18.0pt;background:white\"><span><span lang=\"RO\">c) <b>personal<br \/>\ncontractual<\/b> ori angajat contractual \u2013 persoana numit\u0103 \u00eentr-o func\u0163ie \u00een<br \/>\nautorit\u0103\u0163ile \u015fi institu\u0163iile publice \u00een condi\u0163iile legii nr.53\/2003 \u2013 Codul<br \/>\nMuncii, republicat\u0103, cu modific\u0103rile \u015fi complet\u0103rile ulterioare; <\/span><\/span><\/p>\n<p class=\"MsoNormal\" style=\"text-align:justify;text-indent:18.0pt;background:white\"><span><span lang=\"RO\">d) <b>func\u0163ie<\/b><br \/>\n\u2013 ansamblul atribu\u0163iilor \u015fi responsabilit\u0103\u0163ilor stabilite de autoritatea sau<br \/>\ninstitu\u0163ia public\u0103, \u00een temeiul legii, \u00een fi\u015fa postului; <\/span><span lang=\"RO\"><br \/>\n<\/span><\/span><span><span lang=\"RO\">\u2003\u2003e) <b>interes<br \/>\npublic<\/b> &#8211; acel interes care implic\u0103 garantarea \u015fi respectarea de c\u0103tre<br \/>\ninstitu\u0163iile \u015fi autorit\u0103\u0163ile publice a drepturilor, libert\u0103\u0163ilor \u015fi intereselor<br \/>\nlegitime ale cet\u0103\u0163enilor, recunoscute de Constitu\u0163ie, legisla\u0163ia intern\u0103 \u015fi<br \/>\ntratatele interna\u0163ionale la care Rom\u00e2nia este parte;<\/span><span lang=\"RO\"><br \/>\n<\/span><\/span><span><span lang=\"RO\">\u2003\u2003f) <b>interes<br \/>\npersonal<\/b> &#8211; orice avantaj material sau de alt\u0103 natur\u0103, urm\u0103rit ori ob\u0163inut,<br \/>\n\u00een mod direct sau indirect, pentru sine ori pentru al\u0163ii, de c\u0103tre func\u0163ionarii<br \/>\npublici prin folosirea reputa\u0163iei, influen\u0163ei, facilit\u0103\u0163ilor, rela\u0163iilor,<br \/>\ninforma\u0163iilor la care au acces, ca urmare a exercit\u0103rii func\u0163iei publice;<\/span><span lang=\"RO\"><br \/>\n<\/span><\/span><span><span lang=\"RO\">\u2003\u2003g) <b>conflict<br \/>\nde interese<\/b> &#8211; acea situa\u0163ie sau \u00eemprejurare \u00een care interesul personal,<br \/>\ndirect ori indirect, al func\u0163ionarului public contravine interesului public,<br \/>\nastfel \u00eenc\u00e2t afecteaz\u0103 sau ar putea afecta independen\u0163a \u015fi impar\u0163ialitatea sa<br \/>\n\u00een luarea deciziilor ori \u00eendeplinirea la timp \u015fi cu obiectivitate a<br \/>\n\u00eendatoririlor care \u00eei revin \u00een exercitarea func\u0163iei publice de\u0163inute;<\/span><span lang=\"RO\"><br \/>\n<\/span><\/span><span><span lang=\"RO\">\u2003\u2003h) <b>informa\u0163ie<br \/>\nde interes public<\/b> &#8211; orice informa\u0163ie care prive\u015fte activit\u0103\u0163ile sau care<br \/>\nrezult\u0103 din activit\u0103\u0163ile unei autorit\u0103\u0163i publice ori institu\u0163ii publice,<br \/>\nindiferent de suportul ei;<\/span><span lang=\"RO\"><br \/>\n<\/span><\/span><span><span lang=\"RO\">\u2003\u2003i) <b>informa\u0163ie<br \/>\ncu privire la date personale<\/b> &#8211; orice informa\u0163ie privind o persoan\u0103<br \/>\nidentificat\u0103 sau identificabil\u0103<\/span><\/span><span><b><span lang=\"RO\"><\/span><\/b><\/span><\/p>\n<p class=\"MsoNormal\" style=\"text-align:justify;background:white\"><span><span lang=\"RO\">\u00a0<\/span><\/span><\/p>\n<p class=\"MsoNormal\" style=\"background:white\"><span><span lang=\"RO\">\u00a0<\/span><\/span><\/p>\n<p class=\"MsoNormal\" style=\"background:white\"><span><b><span lang=\"RO\">Loialitatea fa\u0163\u00e3 de<br \/>\nautorit\u00e3\u0163ile \u015fi institu\u0163iile publice<\/p>\n<p><\/span><\/b><\/span><span><b><span lang=\"RO\"><\/span><\/b><\/span><\/p>\n<p class=\"MsoNormal\" style=\"text-align:justify;background:white\"><span><b><span lang=\"RO\">Art.6<\/span><\/b><\/span><span><span lang=\"RO\">\u00a0(1) Personalul are obliga\u0163ia de a ap\u00e3ra \u00een mod loial<br \/>\nprestigiul institu\u0163iei publice \u00een care \u00ee\u015fi desf\u00e3\u015foar\u00e3 activitatea, precum \u015fi de<br \/>\na se ab\u0163ine de la orice act ori fapt care poate produce prejudicii imaginii sau<br \/>\nintereselor legale ale acesteia.<\/span><\/span><\/p>\n<p class=\"MsoNormal\" style=\"text-align:justify;text-indent:21.8pt;background:white\"><span><span lang=\"RO\">\u00a0(2)Personalului<br \/>\n\u00eei este interzis:<br \/>\n\u00a0 \u00a0\u00a0a) s\u00e3 exprime \u00een public aprecieri neconforme cu realitatea<br \/>\n\u00een leg\u00e3tur\u00e3 cu activitatea AJOFM SIBIU, cu politicile \u015fi strategiile acesteia<br \/>\nori cu proiectele de acte cu caracter normativ sau individual. Prevederea se<br \/>\naplica \u0219i dup\u0103 \u00eencetarea raportului de serviciu \/munc\u0103, pe o perioada de 2 ani,<br \/>\ndac\u0103 dispozi\u021biile din legi speciale nu prev\u0103d alte termene;<br \/>\n\u00a0 \u00a0\u00a0b) s\u00e3 fac\u00e3 aprecieri neautorizate \u00een leg\u00e3tur\u00e3 cu litigiile<br \/>\naflate \u00een curs de solu\u0163ionare \u015fi \u00een care institu\u0163ia public\u00e3 \u00een care \u00ee\u015fi<br \/>\ndesf\u00e3\u015foar\u00e3 activitatea are calitatea de parte. Prevederea se aplica \u0219i dup\u0103<br \/>\n\u00eencetarea raportului de serviciu \/munc\u0103, pe o perioada de 2 ani, dac\u0103<br \/>\ndispoz\u021biile din legi speciale nu prevad alte termene;<br \/>\n\u00a0 \u00a0\u00a0c) s\u00e3 dezv\u00e3luie informa\u0163ii care nu au caracter public, \u00een<br \/>\nalte condi\u0163ii dec\u00e2t cele prev\u00e3zute de lege. Prevederea se aplica \u0219i dup\u0103<br \/>\n\u00eencetarea raportului de serviciu \/munc\u0103, pe o perioada de 2 ani, dac\u0103<br \/>\ndispozi\u021biile din legi speciale nu prevad alte termene;<\/span><\/span><\/p>\n<p class=\"MsoNormal\" style=\"text-align:justify;background:white\"><span><span lang=\"RO\">\u00a0 \u00a0\u00a0d) s\u00e3 dezv\u00e3luie<br \/>\ninforma\u0163iile la care au acces \u00een exercitarea func\u0163iei publice, dac\u00e3 aceast\u00e3<br \/>\ndezv\u00e3luire este de natur\u00e3 s\u00e3 atrag\u00e3 avantaje necuvenite ori s\u00e3 prejudicieze<br \/>\nimaginea sau drepturile institu\u0163iei ori ale unor angaja\u021bi, precum \u015fi ale<br \/>\npersoanelor fizice sau juridice. Prevederea se aplica \u0219i dup\u0103 \u00eencetarea<br \/>\nraportului de serviciu \/munc\u0103, pe o perioada de 2 ani, dac\u0103 dispoz\u021biile din<br \/>\nlegi speciale nu prevad alte termene;<br \/>\n\u00a0 \u00a0\u00a0e) s\u00e3 acorde asisten\u0163\u00e3 \u015fi consultan\u0163\u00e3 persoanelor fizice sau<br \/>\njuridice \u00een vederea promov\u00e3rii de ac\u0163iuni juridice ori de alt\u00e3 natur\u00e3 \u00eempotriva<br \/>\nstatului sau a institu\u0163iei publice \u00een care \u00ee\u015fi desf\u00e3\u015foar\u00e3 activitatea.<\/span><\/span><\/p>\n<p class=\"MsoNormal\" style=\"text-align:justify;background:white\"><span><span lang=\"RO\">\u00a0 \u00a0(3) Prevederile<br \/>\nprezentului Cod de etic\u0103 nu pot fi interpretate<span>\u00a0<br \/>\n<\/span>ca o derogare de la obliga\u021bia legal\u0103 a personalului AJOFM Sibiu de a<br \/>\nfurniza informa\u021bii de interes public celor interesa\u021bi, \u00een condi\u021biile legii.<\/span><\/span><\/p>\n<p class=\"MsoNormal\" style=\"text-align:justify;background:white\"><span><span lang=\"RO\">\u00a0(4) Dezv\u00e3luirea informa\u0163iilor<br \/>\ncare nu au caracter public sau remiterea documentelor care con\u0163in asemenea<br \/>\ninforma\u0163ii, la solicitarea reprezentan\u0163ilor unei alte autorit\u00e3\u0163i ori institu\u0163ii<br \/>\npublice, este permis\u00e3 numai cu acordul conduc\u00e3torului institu\u0163iei publice.<\/span><\/span><\/p>\n<p class=\"MsoNormal\" style=\"text-align:justify;background:white\"><span><a name=\"REF5\"><\/a><span lang=\"RO\">\u00a0 <\/span><\/span><\/p>\n<p class=\"MsoNormal\" style=\"background:white\"><span><span lang=\"RO\">\u00a0\u00a0<b>Libertatea<br \/>\nopiniilor<\/b><\/span><\/span><\/p>\n<p class=\"MsoNormal\" style=\"text-align:center;background:white\" align=\"center\"><span><span lang=\"RO\">\u00a0<\/span><\/span><\/p>\n<p class=\"MsoNormal\" style=\"text-align:justify;background:white\"><span><span lang=\"RO\">\u00a0 \u00a0<b>Art.\u00a07<\/b> (1) \u00cen \u00eendeplinirea atribu\u0163iilor de serviciu, personalul<br \/>\nare obliga\u0163ia de a respecta demnitatea func\u0163iei publice de\u0163inute, corel\u00e2nd<br \/>\nlibertatea dialogului cu promovarea intereselor AJOFM Sibiu.<\/span><\/span><\/p>\n<p class=\"MsoNormal\" style=\"text-align:justify;background:white\"><span><span lang=\"RO\">\u00a0 \u00a0\u00a0(2) \u00cen activitatea sa,<br \/>\npersonalul are obliga\u0163ia de a respecta libertatea opiniilor \u015fi de a nu se l\u00e3sa<br \/>\ninfluen\u021ba\u021bi de considerente personale, iar \u00een exprimarea opiniilor,<br \/>\nfunc\u0163ionarii publici din cadrul agentiei de ocupare trebuie s\u00e3 aib\u00e3 o atitudine<br \/>\nconciliant\u00e3 \u015fi s\u00e3 evite generarea conflictelor datorate schimbului de p\u00e3reri.<\/span><\/span><\/p>\n<p class=\"MsoNormal\" style=\"text-align:center;background:white\" align=\"center\"><span><span style=\"font-size:14.0pt\" lang=\"RO\">\u00a0<\/span><\/span><\/p>\n<p class=\"MsoNormal\" style=\"background:white\"><span><span style=\"font-size:14.0pt\" lang=\"RO\">\u00a0 \u00a0\u00a0<\/span><\/span><span><b><span lang=\"RO\">Activitatea public\u00e3<br \/>\n<\/span><\/b><\/span><span><b><span lang=\"RO\">\u00a0\u00a0<\/span><\/b><\/span><\/p>\n<p class=\"MsoNormal\" style=\"text-align:justify;background:white\"><span><span lang=\"RO\">\u00a0 \u00a0<b>Art.8<\/b>\u00a0(1) Rela\u0163iile cu mijloacele de informare \u00een mas\u00e3 se<br \/>\nasigur\u00e3 de c\u00e3tre func\u0163ionar public desemnat \u00een acest sens de conduc\u00e3torul AJOFM<br \/>\nSibiu, prin decizie sau fi\u0219a postului.<\/span><\/span><\/p>\n<p class=\"MsoNormal\" style=\"text-align:justify;background:white\"><span><span lang=\"RO\">\u00a0 \u00a0\u00a0(2) Persoana<br \/>\ndesemnata s\u00e3 participe la activit\u00e3\u0163i sau dezbateri publice, \u00een calitate<br \/>\noficial\u00e3, trebuie s\u00e3 respecte limitele mandatului de reprezentare \u00eencredin\u0163at<br \/>\nde conduc\u00e3torul AJOFM Sibiu.<br \/>\n\u00a0 \u00a0\u00a0(3) \u00cen cazul \u00een care nu sunt desemna\u0163i \u00een acest sens,<br \/>\npersonalul poate participa la activit\u00e3\u0163i sau dezbateri publice, av\u00e2nd obliga\u0163ia<br \/>\nde a face cunoscut faptul c\u00e3 opinia exprimat\u00e3 nu reprezint\u00e3 punctul de vedere<br \/>\noficial al AJOFM Sibiu.<\/span><\/span><\/p>\n<p class=\"MsoNormal\" style=\"text-align:justify;background:white\"><span><span lang=\"RO\">\u00a0 \u00a0\u00a0<\/span><\/span><\/p>\n<p class=\"MsoNormal\" style=\"margin-left:4.5pt;text-indent:9.7pt;background:white\"><span><span style=\"font-size:14.0pt\" lang=\"RO\"><span>\u00a0\u00a0 <\/span><\/span><\/span><span><b><span lang=\"RO\">Activitatea politic\u00e3<\/p>\n<p><\/span><\/b><\/span><\/p>\n<p class=\"MsoNormal\" style=\"text-align:justify;background:white\"><span><b><span lang=\"RO\">Art.9<\/span><\/b><\/span><span><span lang=\"RO\">\u00a0\u00a0\u00cen exercitarea func\u021biei publice sau a func\u021biei<br \/>\nde\u021binute, personalului \u00eei este interzis:<\/span><\/span><\/p>\n<p class=\"MsoNormal\" style=\"margin-left:54.0pt;text-align:justify;text-indent:-18.0pt;background:white\"><span><span lang=\"RO\"><span>a)<span style=\"font:7.0pt\">\u00a0\u00a0 <\/span><\/span><\/span><span lang=\"RO\">s\u0103 participe la colectarea de fonduri pentru activitatea<br \/>\npartidelor politice;<\/span><\/span><\/p>\n<p class=\"MsoNormal\" style=\"margin-left:54.0pt;text-align:justify;text-indent:-18.0pt;background:white\"><span><span lang=\"RO\"><span>b)<span style=\"font:7.0pt\">\u00a0\u00a0 <\/span><\/span><\/span><span lang=\"RO\">s\u0103 furnizeze sprijin logistic candida\u0163ilor la func\u0163ii de<br \/>\ndemnitate public\u00e3;<\/span><\/span><\/p>\n<p class=\"MsoNormal\" style=\"margin-left:54.0pt;text-align:justify;text-indent:-18.0pt;background:white\"><span><span lang=\"RO\"><span>c)<span style=\"font:7.0pt\">\u00a0\u00a0\u00a0 <\/span><\/span><\/span><span lang=\"RO\">s\u0103 colaboreze, \u00een afara rela\u0163iilor de serviciu, cu<br \/>\npersoanele fizice sau juridice care fac dona\u0163ii ori sponsoriz\u00e3ri partidelor<br \/>\npolitice;<\/span><\/span><\/p>\n<p class=\"MsoNormal\" style=\"margin-left:54.0pt;text-align:justify;text-indent:-18.0pt;background:white\"><span><span lang=\"RO\"><span>d)<span style=\"font:7.0pt\">\u00a0\u00a0 <\/span><\/span><\/span><span lang=\"RO\">s\u0103 afi\u015feze, \u00een cadrul autorit\u00e3\u0163ilor sau institu\u0163iilor<br \/>\npublice, \u00eensemne ori obiecte inscrip\u0163ionate cu sigla sau denumirea partidelor<br \/>\npolitice ori a candida\u0163ilor acestora.<\/span><\/span><\/p>\n<p class=\"MsoNormal\" style=\"margin-left:54.0pt;text-align:justify;text-indent:-18.0pt;background:white\"><span><span lang=\"RO\"><span>e)<span style=\"font:7.0pt\">\u00a0\u00a0 <\/span><\/span><\/span><span lang=\"RO\">func\u021bionarilor publici le este interzis s\u0103 fac\u0103 parte din<br \/>\nconducerea partidelor sau organiza\u021biilor politice.<\/span><\/span><\/p>\n<p class=\"MsoNormal\" style=\"background:white\"><span><span style=\"font-size:14.0pt\" lang=\"RO\">\u00a0<\/span><\/span><\/p>\n<p class=\"MsoNormal\" style=\"background:white\"><span><b><span lang=\"RO\">Folosirea imaginii proprii<\/span><\/b><\/span><\/p>\n<p class=\"MsoNormal\" style=\"text-align:justify;background:white\"><span><span style=\"font-size:14.0pt\" lang=\"RO\"><br \/>\n<\/span><\/span><span><b><span lang=\"RO\">Art.10<\/span><\/b><\/span><span><span lang=\"RO\">\u00a0\u00a0\u00cen considerarea func\u0163iei<br \/>\npublice de\u0163inute, personalul are obliga\u021bia de a nu permite utilizarea numelui<br \/>\nsau imaginii proprii \u00een ac\u0163iuni publicitare pentru promovarea unei activit\u00e3\u0163i<br \/>\ncomerciale, precum \u015fi \u00een scopuri electorale.<\/span><\/span><\/p>\n<p class=\"MsoNormal\" style=\"text-align:justify;background:white\"><span><span lang=\"RO\">\u00a0 \u00a0\u00a0<\/span><\/span><\/p>\n<p class=\"MsoNormal\" style=\"background:white\"><span><b><span lang=\"RO\">Cadrul rela\u0163iilor \u00een<br \/>\nexercitarea func\u0163iei publice<\/p>\n<p><\/span><\/b><\/span><\/p>\n<p class=\"MsoNormal\" style=\"text-align:justify;background:white\"><span><span lang=\"RO\">\u00a0<b>Art.11<\/b>\u00a0(1) \u00cen rela\u0163iile cu personalul din cadrul institu\u0163iei,<br \/>\nprecum \u015fi cu persoanele fizice sau juridice, personalul este obligat s\u00e3 aib\u0103 un<br \/>\ncomportament bazat pe respect, bun\u00e3-credin\u0163\u00e3, corectitudine \u015fi style=\"margin-left:74.25pt;text-align:justify;text-indent:-18.0pt;background:white\"><span><span lang=\"RO\"><span>a)<span style=\"font:7.0pt\">\u00a0\u00a0 <\/span><\/span><\/span><span lang=\"RO\">\u00eentrebuin\u0163area unor expresii jignitoare;<\/span><\/span><\/p>\n<p class=\"MsoNormal\" style=\"margin-left:74.25pt;text-align:justify;text-indent:-18.0pt;background:white\"><span><span lang=\"RO\"><span>b)<span style=\"font:7.0pt\">\u00a0\u00a0 <\/span><\/span><\/span><span lang=\"RO\">Art.15<\/span><\/b><\/span><span><b><span style=\"font-size:14.0pt\" lang=\"RO\"> <\/span><\/b><\/span><span><span lang=\"RO\">(1)<b> <\/b>Directorul<br \/>\nexecutiv al AJOFM Sibiu va dispune constituirea unei comisii alc\u0103tuite din 3<br \/>\npersoane de specialitate din cadrul Serviciului Administrare buget, care va evalua<br \/>\n\u0219i va inventaria bunurile prev\u0103zute la art.14 alin.(1).<\/span><\/span><\/p>\n<p class=\"MsoNormal\" style=\"margin-top:0cm;margin-right:14.4pt;margin-bottom:0cm;margin-left:14.4pt;margin-bottom:.0001pt;text-align:justify;background:white\"><span><span lang=\"RO\"><span>\u00a0\u00a0\u00a0\u00a0\u00a0 <\/span>(2) Comisia prev\u0103zut\u0103 la alin. (1) \u021bine<br \/>\neviden\u021ba bunurilor primite de fiecare persoan\u0103 \u0219i \u00eenainte de finele anului,<br \/>\npropune conducerii AJOFM Sibiu, rezolvarea situa\u021biei bunurilor.<\/span><\/span><\/p>\n<p class=\"MsoNormal\" style=\"text-align:justify;text-indent:21.8pt;background:white\"><span><span lang=\"RO\">(3) \u00cen cazurile \u00een<br \/>\ncare valoarea bunurilor stabilit\u0103 de comisie este mai mare dec\u00e2t echivalentul a<br \/>\n200 euro, persoana care a primit bunurile poate solicita p\u0103strarea lor, platind<br \/>\ndiferen\u021ba de valoare. Dac\u0103 valoarea bunurilor stabilit\u0103 de comisie este sub<br \/>\nechivalentul a 200 euro, acestea se p\u0103streaz\u0103 de c\u0103tre primitor.<\/span><\/span><\/p>\n<p class=\"MsoNormal\" style=\"text-align:justify;background:white\"><span><span lang=\"RO\"><span>\u00a0\u00a0\u00a0\u00a0\u00a0 <\/span>(4)<br \/>\n\u00cen cazul \u00een care persoana care a primit bunurile nu a solicitat p\u0103strarea lor,<br \/>\nla propunerea comisiei prev\u0103zute la alin.(1), bunurile r\u0103m\u00e2n \u00een patrimoniul<br \/>\ninstitu\u021biei sau pot fi transmise cu titlu gratuit unei institu\u021bii publice de<br \/>\nprofil ori v\u00e2ndute la licita\u021bie, \u00een condi\u021biile legii.<\/span><\/span><\/p>\n<p class=\"MsoNormal\" style=\"text-align:justify;background:white\"><span><span lang=\"RO\"><span>\u00a0\u00a0\u00a0\u00a0\u00a0 <\/span>(5)<br \/>\nVeniturile ob\u021binute ca urmare a valorific\u0103rii acestor bunuri se vars\u0103 la<br \/>\nbugetul statului.<\/span><\/span><\/p>\n<p class=\"MsoNormal\" style=\"text-align:justify;background:white\"><span><span lang=\"RO\"><span>\u00a0\u00a0\u00a0\u00a0\u00a0 <\/span><\/span><\/span><\/p>\n<p class=\"MsoNormal\" style=\"text-align:justify;background:white\"><span><span lang=\"RO\"><span>\u00a0<\/span><\/span><\/span><\/p>\n<p class=\"MsoNormal\" style=\"background:white\"><span><b><span lang=\"RO\">Participarea la<br \/>\nprocesul de luare a deciziilor<\/span><\/b><\/span><span><b><span style=\"font-size:14.0pt\" lang=\"RO\"><\/p>\n<p><\/span><\/b><\/span><span><b><span style=\"font-size:14.0pt\" lang=\"RO\"><\/span><\/b><\/span><\/p>\n<p class=\"MsoNormal\" style=\"text-align:justify;background:white\"><span><b><span lang=\"RO\">Art.16<\/span><\/b><\/span><span><span lang=\"RO\">\u00a0(1) \u00cen procesul de luare a deciziilor, personalul are style=\"background:white\"><span><b><span lang=\"RO\">Obiectivitate \u00een<br \/>\nevaluare<\/p>\n<p><\/span><\/b><\/span><\/p>\n<p class=\"MsoNormal\" style=\"margin-top:0cm;margin-right:14.2pt;margin-bottom:0cm;margin-left:4.5pt;margin-bottom:.0001pt;text-align:justify;background:white\"><span><b><span competen\u0163ei<br \/>\nprofesionale pentru personalul din subordine, atunci c\u00e2nd propune ori aprob\u00e3<br \/>\navans\u00e3ri, promov\u00e3ri, transferuri, numiri sau eliber\u00e3ri din func\u0163ii ori<br \/>\nacordarea de stimulente materiale sau morale, excluz\u00e2nd orice form\u00e3 de<br \/>\nfavoritism ori discriminare.<br \/>\n\u00a0 \u00a0\u00a0<span>\u00a0\u00a0\u00a0 <\/span><span>\u00a0\u00a0 <\/span>(3) Se interzice personalului de conducere<br \/>\ns\u00e3 favorizeze sau s\u00e3 defavorizeze accesul ori promovarea \u00een func\u0163ia public\u00e3 pe<br \/>\ncriterii discriminatorii, de rudenie, afinitate sau alte criterii neconforme cu<br \/>\nprincipiile prev\u00e3zute la art. 4 din prezentul Cod de etic\u0103.<\/p>\n<p><\/span><\/span><\/p>\n<p style=\"background:white\"><span><b><span lang=\"RO\">Folosirea abuziva a prerogativelor<br \/>\nde putere public\u00e3 de catre functionarii publici din cadrul agentiei de ocupare<\/p>\n<p><\/span><\/b><\/span><span><b><span lang=\"RO\"><\/span><\/b><\/span><\/p>\n<p class=\"MsoNormal\" style=\"background:white\"><span><b><span style=\"font-size:14.0pt\" lang=\"RO\">\u00a0<\/span><\/b><\/span><\/p>\n<p class=\"MsoNoSpacing\" style=\"text-align:justify\"><span><b><span lang=\"RO\">Art. 18<\/span><\/b><span lang=\"RO\"> (1) Este interzis\u00e3 folosirea de c\u00e3tre personalul AJOFM Sibiu a prerogativelor<br \/>\nfunc\u0163iei publice de\u0163inute \u00een alte scopuri dec\u00e2t cele prev\u00e3zute de lege. <\/span><\/span><\/p>\n<p class=\"MsoNoSpacing\" style=\"text-align:justify\"><span><span lang=\"RO\"><span>\u00a0<\/span>\u00a0\u00a0(2) Prin<br \/>\nactivitatea de luare a deciziilor, de consiliere, de elaborare a proiectelor de<br \/>\nacte normative, de evaluare sau de participare la anchete ori ac\u0163iuni de<br \/>\ncontrol, personalului din cadrul agentiei de ocupare \u00eei este interzis\u00e3 urm\u00e3rirea<br \/>\nob\u0163inerii de foloase sau avantaje \u00een interes personal ori producerea de<br \/>\nprejudicii materiale sau morale altor persoane.<\/span><\/span><\/p>\n<p class=\"MsoNoSpacing\" style=\"text-align:justify\"><span><span lang=\"RO\">\u00a0 (3) Personalului \u00eei este interzis s\u00e3 foloseasc\u00e3<br \/>\npozi\u0163ia oficial\u00e3 pe care o de\u0163ine sau rela\u0163iile pe care le-au stabilit \u00een exercitarea<br \/>\nfunc\u0163iei publice, pentru a influen\u0163a anchetele interne ori externe sau pentru a<br \/>\ndetermina luarea unei anumite m\u00e3suri.<\/span><\/span><\/p>\n<p class=\"MsoNoSpacing\" style=\"margin-left:18.0pt;text-align:justify;text-indent:4.5pt\"><span><span lang=\"RO\"><span>(4)<span style=\"font:7.0pt\">\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0<br \/>\n<\/span><\/span><\/span><span lang=\"RO\"><span>\u00a0<\/span>personalului \u00eei este interzis s\u00e3 impun\u00e3 altor<br \/>\nfunc\u0163ionari publici s\u00e3 se \u00eenscrie \u00een organiza\u0163ii sau asocia\u0163ii, indiferent de<br \/>\nnatura acestora, ori s\u00e3 le sugereze acest lucru, promi\u0163\u00e2ndu-le acordarea unor<br \/>\navantaje materiale sau profesionale.<\/span><\/span><\/p>\n<p class=\"MsoNormal\" style=\"margin-left:31.5pt;text-align:justify;background:white\"><span><span lang=\"RO\">\u00a0 \u00a0<\/span><\/span><\/p>\n<p class=\"MsoNormal\" style=\"margin-left:0cm;text-indent:13.5pt;background:white\"><span><b><span lang=\"RO\">Utilizarea resurselor publice<\/p>\n<p><\/span><\/b><\/span><\/p>\n<p class=\"MsoNormal\" style=\"text-align:justify;background:white\"><span><b><span lang=\"RO\">Art.19<\/span><\/b><\/span><span><span lang=\"RO\">\u00a0(1) Personalul este obligat s\u0103 asigure ocrotirea<br \/>\npropriet\u00e3\u0163ii publice \u015fi private a statului \u015fi institu\u021biei, s\u00e3 evite producerea<br \/>\noric\u00e3rui prejudiciu, ac\u0163ion\u00e2nd \u00een orice situa\u0163ie ca un bun proprietar.<br \/>\n\u00a0 \u00a0<span>\u00a0\u00a0 <\/span>\u00a0(2) Personalul are obliga\u0163ia<br \/>\ns\u00e3 foloseasc\u00e3 timpul de lucru, precum \u015fi bunurile apar\u0163in\u00e2nd AJOFM Sibiu numai<br \/>\npentru desf\u00e3\u015furarea activit\u00e3\u0163ilor aferente func\u0163iei publice de\u0163inute.<br \/>\n\u00a0 \u00a0<span>\u00a0\u00a0 <\/span>\u00a0(3) Personalul<br \/>\ntrebuie s\u00e3 propun\u00e3 \u015fi s\u00e3 asigure, potrivit atribu\u0163iilor care le revin,<br \/>\nfolosirea util\u00e3 \u015fi eficient\u00e3 a banilor publici, \u00een conformitate cu concesion\u00e3ri sau \u00eenchirieri<\/span><\/b><\/span><\/p>\n<p class=\"MsoNormal\" style=\"text-align:justify;background:white\"><span><span lang=\"RO\"><br \/>\n<b>Art.20<\/b>\u00a0(1) Personalul poate<br \/>\nachizi\u0163iona un bun aflat \u00een proprietatea privat\u00e3 a statului sau a unit\u00e3\u0163ilor<br \/>\nadministrativ-teritoriale, supus v\u00e2nz\u00e3rii \u00een informa\u0163ii la care<br \/>\npersoanele interesate de cump\u00e3rarea bunului nu au avut acces.<br \/>\n\u00a0 \u00a0\u00a0(2) Dispozi\u0163iile alin. (1) se aplic\u00e3 \u00een mod corespunz\u00e3tor \u015fi<br \/>\n\u00een cazul concesion\u00e3rii sau \u00eenchirierii unui bun aflat \u00een proprietatea public\u00e3<br \/>\nori privat\u00e3 a <\/span>(3)<br \/>\nPrin activitatea sa, Agen\u021bia Na\u021bional\u0103 a Func\u021bionarilor Publici nu poate<br \/>\ninfluen\u021ba derularea procedurii de lucru a comisiei de disciplin\u0103 din cadrul<br \/>\nAJOFM Sibiu , desf\u0103\u0219urat\u0103 \u00een conformitate cu prevederile Hot\u0103r\u00e2rii Guvernului<br \/>\nnr.1344\/2007 privind normele de organizare \u0219i func\u021bionare a comisiilor de<br \/>\ndisciplin\u0103, cu modific\u0103rile \u0219i complet\u0103rile ulterioare.<\/span><\/span><\/p>\n<p class=\"MsoNormal\" style=\"margin-right:2.85pt;margin-bottom:6.0pt;text-align:justify;background:white\"><span><span lang=\"RO\"><span>\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 <\/span>(4)<br \/>\nPrin activitatea sa, Ministerul Administra\u021biei \u0219i Internelor nu poate influen\u021ba<br \/>\nderularea procedurii disciplinare din cadrul AJOFM Sibiu, desf\u0103\u0219urat\u0103 \u00een<br \/>\nconformitate cu prevederile Legii nr.53\/2003 \u2013 Codul Muncii, republicat\u0103, cu<br \/>\nmodific\u0103rile \u0219i complet\u0103rile ulterioare.<\/span><\/span><span><b><span style=\"font-size:14.0pt\" lang=\"RO\"><\/span><\/b><\/span><\/p>\n<p class=\"MsoNormal\" style=\"margin-right:2.85pt;margin-bottom:6.0pt;text-align:justify;background:white\"><span><b><span lang=\"RO\">Art.22 (1)<\/span><\/b><\/span><span><b><span style=\"font-size:14.0pt\" lang=\"RO\"> <\/span><\/b><\/span><span><span lang=\"RO\">\u00cen cazul personalului din cadrul AJOFM Sibiu, monitorizarea \u0219i<br \/>\ncontrolul aplic\u0103rii normelor prev\u0103zute de prezentul <i>Cod de <\/span><\/span><\/span><span lang=\"RO\">pentru personalul contractual, monitorizarea \u0219i controlul se<br \/>\nrealizeaz\u0103 de c\u0103tre un func\u021bionar public din cadrul Compartimentul Resurse<br \/>\numane, salarizare, comunicare \u0219i secretariatul Consiliului Consultativ, altul<br \/>\ndec\u00e2t consilierul etic, care va \u00eendeplini atribu\u021biile prev\u0103zute \u00een Legea<br \/>\nnr.477\/2004 privind Codul de etic\u0103 \u0219i conduit\u0103 profesional\u0103 a personalului<br \/>\ncontractual din autorit\u0103\u021bile \u0219i entit\u0103\u021bile publice.<\/span><\/span><\/p>\n<p class=\"MsoNormal\" style=\"margin-right:2.85pt;margin-bottom:6.0pt;margin-left:32.2pt;text-align:justify;background:white\"><span><span lang=\"RO\">(2) Persoanele men\u021bionate la alin.(1) lit.<br \/>\na) \u0219i lit.b) vor fi nominalizate prin act administrativ, iar fi\u0219a postului se<br \/>\nva completa \u00een mod corespunz\u0103tor cu noile atribu\u021bii.<\/span><\/span><\/p>\n<p class=\"MsoNormal\" style=\"margin-right:2.85pt;margin-bottom:6.0pt;margin-left:32.2pt;text-align:justify;background:white\"><span><b><span lang=\"RO\">Atribu\u021biile persoanelor responsabile cu monitorizarea Codului de<br \/>\netic\u0103 \u0219i conduit\u0103 profesional\u0103<\/span><\/b><\/span><\/p>\n<p class=\"MsoNormal\" style=\"text-align:center;background:white\" align=\"center\"><span><b><span style=\"font-size:14.0pt\" lang=\"RO\">\u00a0<\/span><\/b><\/span><\/p>\n<p class=\"MsoNormal\" style=\"text-align:justify;background:white\"><span><b><span lang=\"RO\">Art.23<\/span><\/b><\/span><span><span style=\"font-size:14.0pt\" lang=\"RO\"> <\/span><\/span><span><span lang=\"RO\">Referitor<\/span><\/span><span><span style=\"font-size:14.0pt\" lang=\"RO\"> <\/span><\/span><span><span lang=\"RO\">la func\u021bionarii publici din cadrul AJOFM Sibiu, persoana<br style=\"font:7.0pt\">\u00a0\u00a0 <\/span><\/span><\/span><span lang=\"RO\">monitorizeaz\u0103 aplicarea prevederilor Codului de conduit\u0103 a<br \/>\nfunc\u021bionarilor publici \u00een cadrul institu\u021biei;<\/span><\/span><\/p>\n<p class=\"MsoNormal\" style=\"margin-left:32.2pt;text-align:justify;text-indent:-18.0pt;background:white\"><span><span lang=\"RO\"><span>c)<span style=\"font:7.0pt\">\u00a0\u00a0\u00a0 <\/span><\/span><\/span><span lang=\"RO\">\u00eentocme\u0219te \u0219i transmite Agen\u021biei Na\u021bionale a Func\u021bionarilor<br \/>\nPublici, rapoarte trimestriale privind respectarea normelor de conduit\u0103 de<br \/>\nc\u0103tre func\u021bionarii publici, conform prevederilor<span>\u00a0 <\/span>art.6<span>\u00a0<br \/>\n<\/span>alin.(1) din Ordinul Pre\u0219edintelui Agen\u021biei Na\u021bionale a Func\u021bionarilor<br \/>\nPublici nr.3753\/2015 privind monitorizarea respect\u0103rii normelor de conduit\u0103 de<br \/>\nc\u0103tre func\u021bionarii publici \u0219i a implement\u0103rii procedurilor disciplinare;<\/span><\/span><\/p>\n<p class=\"MsoNormal\" style=\"margin-left:32.2pt;text-align:justify;text-indent:-18.0pt;background:white\"><span><span lang=\"RO\"><span>d)<span style=\"font:7.0pt\">\u00a0\u00a0 <\/span><\/span><\/span><span lang=\"RO\">transmite Agen\u021biei Na\u021bionale a Func\u021bionarilor Publici,<br \/>\nRaportul privind implementarea procedurilor disciplinare, \u00eentocmit, semestrial,<br \/>\nde c\u0103tre pre\u0219edintele comisiei de disciplin\u0103 a func\u021bionarilor publici din<br \/>\ncadrul AJOFM Sibiu, conform prevederilor art.6 alin.(3) din Ordinul Pre\u0219edintelui<br \/>\nAgen\u021biei Na\u021bionale a Func\u021bionarilor Publici.<\/span><\/span><\/p>\n<p class=\"MsoNormal\" style=\"margin-left:32.2pt;text-align:justify;text-indent:-18.0pt;background:white\"><span><span lang=\"RO\">formuleaz\u0103 recomandari de solu\u021bionare a cazurilor cu care a<br \/>\nfost sesizat;<\/span><\/span><\/p>\n<p class=\"MsoNormal\" disciplinare:<\/b><\/span><\/span><\/p>\n<p class=\"MsoNormal\" style=\"text-align:justify;background:white\"><span><span lang=\"RO\">\u00eent\u00e2rzierea sistematic\u0103 \u00een efectuarea<br \/>\nlucr\u0103rilor;<\/span><\/span><\/p>\n<p class=\"MsoNormal\" style=\"text-align:justify;background:white\"><span><span lang=\"RO\">\u2003\u2003b) neglijen\u0163a repetat\u0103 \u00een rezolvarea<br \/>\nlucr\u0103rilor;<\/span><\/span><\/p>\n<p class=\"MsoNormal\" style=\"text-align:justify;background:white\"><span><span lang=\"RO\">\u2003\u2003c) absen\u0163e nemotivate de la serviciu;<\/span><\/span><\/p>\n<p class=\"MsoNormal\" style=\"text-align:justify;background:white\"><span><span lang=\"RO\">\u2003\u2003d) nerespectarea \u00een mod repetat a<br \/>\nprogramului de lucru;<\/span><\/span><\/p>\n<p class=\"MsoNormal\" style=\"text-align:justify;background:white\"><span><span lang=\"RO\">\u2003\u2003e) interven\u0163iile sau st\u0103ruin\u0163ele<br \/>\npentru solu\u0163ionarea unor cereri \u00een afara cadrului legal;<\/span><\/span><\/p>\n<p class=\"MsoNormal\" style=\"text-align:justify;background:white\"><span><span lang=\"RO\">\u2003\u2003f) nerespectarea secretului<br \/>\nprofesional sau a confiden\u0163ialit\u0103\u0163ii lucr\u0103rilor cu acest caracter;<\/span><\/span><\/p>\n<p class=\"MsoNormal\" style=\"text-align:justify;background:white\"><span><span lang=\"RO\">\u2003\u2003g) manifest\u0103ri care aduc atingere<br \/>\nprestigiului autorit\u0103\u0163ii sau institu\u0163iei publice \u00een care \u00ee\u015fi desf\u0103\u015foar\u0103<br \/>\nactivitatea;<\/span><\/span><\/p>\n<p class=\"MsoNormal\" style=\"text-align:justify;background:white\"><span><span lang=\"RO\">\u2003\u2003h) desf\u0103\u015furarea \u00een timpul programului<br \/>\nde lucru a unor activit\u0103\u0163i cu caracter politic;<\/span><\/span><\/p>\n<p class=\"MsoNormal\" style=\"text-align:justify;background:white\"><span><span lang=\"RO\">\u2003\u2003i) refuzul de a \u00eendeplini atribu\u0163iile<br \/>\nde serviciu;<\/span><\/span><\/p>\n<p class=\"MsoNormal\" style=\"text-align:justify;background:white\"><span><span lang=\"RO\">\u2003\u2003j) \u00eenc\u0103lcarea prevederilor legale<br \/>\nreferitoare la \u00eendatoriri, incompatibilit\u0103\u0163i, conflicte de interese \u015fi<br \/>\ninterdic\u0163ii stabilite prin lege pentru func\u0163ionarii publici;<\/span><\/span><\/p>\n<p class=\"MsoNormal\" style=\"text-align:justify;background:white\"><span><span lang=\"RO\">\u2003\u2003k) alte fapte prev\u0103zute ca abateri<br \/>\ndisciplinare \u00een actele normative din domeniul func\u0163iei publice \u015fi<br \/>\nfunc\u0163ionarilor publici.<\/span><\/span><\/p>\n<p class=\"MsoNormal\" style=\"text-align:justify;background:white\"><span><span lang=\"RO\"><span>\u00a0\u00a0\u00a0\u00a0\u00a0 <\/span>(3)<br \/>\n\u00cen cazul <b>func\u0163ionarilor publici, <\/b>potrivit<br \/>\nart.77 alin.(3) din Legea nr.188\/1999, republicat\u0103, cu modific\u0103rile \u015fi<br \/>\ncomplet\u0103rile ulterioare, <b>sanc\u0163iunile<br \/>\ndisciplinare<\/b> sunt urm\u0103toarele:<\/span><\/span><\/p>\n<p class=\"MsoNormal\" style=\"text-align:justify;background:white\"><span><span lang=\"RO\"><span>\u00a0\u00a0\u00a0\u00a0<br \/>\n<\/span>a) mustrare scris\u0103;<\/span><\/span><\/p>\n<p class=\"MsoNormal\" style=\"text-align:justify;background:white\"><span><span lang=\"RO\">\u2003\u2003b) diminuarea drepturilor salariale<br \/>\ncu 5-20% pe o perioad\u0103 de p\u00e2n\u0103 la 3 luni;<\/span><\/span><\/p>\n<p class=\"MsoNormal\" style=\"text-align:justify;background:white\"><span><span lang=\"RO\">\u2003\u2003c) suspendarea dreptului de avansare<br \/>\n\u00een gradele de salarizare sau, dup\u0103 caz, de promovare \u00een func\u0163ia public\u0103 pe o<br \/>\nperioad\u0103 de la 1 la 3 ani; <\/span><\/span><\/p>\n<p class=\"MsoNormal\" style=\"text-align:justify;background:white\"><span><span lang=\"RO\">\u2003\u2003d) retrogradarea \u00een func\u0163ia public\u0103<br \/>\npe o perioad\u0103 de p\u00e2n\u0103 la un public\u0103<\/span><\/span><\/p>\n<p class=\"MsoNormal\" style=\"margin-left:67.5pt;text-align:justify;background:white\"><span><span lang=\"RO\">\u00a0<\/span><\/span><\/p>\n<p class=\"MsoNormal\" style=\"margin-left:40.5pt;text-align:justify;text-indent:-18.0pt;background:white\"><span><span lang=\"RO\"><span>(4)<span style=\"font:7.0pt\">\u00a0 <\/span><\/span><\/span><span lang=\"RO\">\u00cen cazul <b>personalului<br \/>\ncontractual<\/b>, potrivit prevederilor art.250 din Legea nr.53\/2003 \u2013 Codul<br \/>\nmuncii, republicat\u0103, cu modific\u0103rile \u015fi complet\u0103rile ulterioare, sanc\u0163iunile<br \/>\ndisciplinare se aplic\u0103 \u00een raport cu gravitatea abaterii disciplinare s\u0103v\u00e2r\u015fite<br \/>\nde salariat, av\u00e2ndu-se \u00een vedere urm\u0103toarele:<\/span><\/span><\/p>\n<p class=\"MsoNormal\" style=\"margin-left:40.5pt;text-align:justify;background:white\"><span><b><span lang=\"RO\"><span>\u00a0 <\/span>\u2003<span>\u00a0\u00a0\u00a0 <\/span><\/span><\/b><\/span><span><span lang=\"RO\">a) \u00eemprejur\u0103rile \u00een care fapta a fost s\u0103v\u00e2r\u015fit\u0103;<\/span><\/span><\/p>\n<p \/>\nprevederilor art.248 din Legea nr.53\/2003 \u2013 Codul muncii, republicat\u0103, cu<br \/>\nmodific\u0103rile \u015fi complet\u0103rile ulterioare sunt:<\/span><\/span><\/p>\n<p class=\"MsoNormal\" style=\"margin-left:93.75pt;text-align:justify;text-indent:-18.0pt;background:white\"><span><span lang=\"RO\"><span>a)<span style=\"font:7.0pt\">\u00a0\u00a0 style=\"margin-left:50.2pt;text-align:justify;text-indent:-18.0pt;background:white\"><span><span lang=\"RO\"><span>b)<span style=\"font:7.0pt\">\u00a0\u00a0 <\/span><\/span><\/span><span lang=\"RO\">Categoriile \u015fi num\u0103rul de angaja\u0163i contractuali care au<br \/>\n\u00eenc\u0103lcat normele de conduit\u0103 moral\u0103 \u015fi profesional\u0103;<\/span><\/span><\/p>\n<p class=\"MsoNormal\" style=\"margin-left:50.2pt;text-align:justify;text-indent:-18.0pt;background:white\"><span><span lang=\"RO\"><span>c)<span style=\"font:7.0pt\">\u00a0\u00a0\u00a0 <\/span><\/span><\/span><span lang=\"RO\">Cauzele \u015fi consecin\u0163ele nerespect\u0103rii prevederile<br \/>\nprezentului cod de conduita moral\u0103 \u015fi style=\"font:7.0pt\">\u00a0\u00a0 <\/span><\/span><\/span><span lang=\"RO\">Eviden\u0163ierea cazurilor \u00een care personului contractual i s-a<br \/>\ncerut \u015f\u0103 ac\u0163ioneze sub presiunea factorului politic;<\/span><\/span><\/p>\n<p class=\"MsoNormal\" style=\"margin-left:50.2pt;text-align:justify;text-indent:-18.0pt;background:white\"><span><span lang=\"RO\"><span>e)<span unele cazuri un interes<br \/>\ndeosebit pentru opinia public\u0103.<\/span><\/span><\/p>\n<p class=\"MsoNormal\" style=\"margin-left:32.2pt;text-align:justify;background:white\"><span><span lang=\"RO\">(3) Raportul anual cu<br \/>\nprivire la Standardul de conduit\u0103 a personalului contractual se public\u0103 pe<br \/>\npagina de Internet a AJOFM Sibiu.<\/span><\/span><\/p>\n<p class=\"MsoNormal\" style=\"text-align:justify;background:white\"><span><b><span style=\"font-size:14.0pt\" lang=\"RO\">\u00a0<\/span><\/b><\/span><\/p>\n<p class=\"MsoNormal\" lang=\"RO\"><span>\u00a0\u00a0\u00a0\u00a0 <\/span><\/span><\/b><\/span><span><span lang=\"RO\">(2) Personalul nu poate fi sanc\u0163ionat<br \/>\nsau prejudiciat \u00een nici un fel pentru sesizarea cu bun\u0103 \u2013 credin\u0163\u0103 a comisiilor<br \/>\nde disciplin\u0103, \u00een condi\u0163iile legii, cu privire la cazurile de \u00eenc\u0103lcare a<br \/>\nnormelor de conduit\u0103.<\/span><\/span><\/p>\n<p class=\"MsoNormal\" style=\"text-align:justify;background:white\"><span><span lang=\"RO\"><span>\u00a0\u00a0\u00a0\u00a0\u00a0 <\/span>(3)<br \/>\n\u00cen cazurile \u00een care, faptele s\u0103v\u00e2r\u015fite \u00eentrunesc elementele constitutive ale<br \/>\nunor infrac\u0163iuni, conducerea AJOFM Sibiu va sesiza organele de urm\u0103rire penal\u0103<br \/>\ncompetitive, \u00een condi\u0163iile legii.<\/span><\/span><\/p>\n<p class=\"MsoNormal\" style=\"text-align:justify;background:white\"><span><span lang=\"RO\"><span>\u00a0\u00a0\u00a0\u00a0\u00a0 <\/span>(4)<br \/>\nPersonalul r\u0103spunde, potrivit legii, \u00een cazul \u00een care, prin faptele s\u0103v\u00e2r\u015fite<br \/>\ncu \u00eenc\u0103lcarea normelor de conduit\u0103 profesional\u0103, creaz\u0103 prejudicii persoanelor<br \/>\nfizice sau juridice, prin activitatea desf\u0103\u015furat\u0103 \u00een cadrul AJOFM Sibiu.<\/span><\/span><\/p>\n<p class=\"MsoNormal\" style=\"text-align:justify;background:white\"><span><span lang=\"RO\">\u00a0<\/span><\/span><\/p>\n<p class=\"MsoNormal\" style=\"text-align:justify;background:white\"><span><b><span lang=\"RO\">Armonizarea regulamentelor interne de organizare \u015fi func\u0163ionare<\/span><\/b><\/span><\/p>\n<p class=\"MsoNormal\" style=\"text-align:justify;background:white\"><span><span lang=\"RO\">\u00a0<\/span><\/span><\/p>\n<p class=\"MsoNormal\" style=\"text-align:justify;background:white\"><span><b><span lang=\"RO\">Art.30<\/span><\/b><\/span><span><span lang=\"RO\"> Prevederile prezentului cod de etic\u0103 \u015fi conduit\u0103<br \/>\nprofesional\u0103 se vor armoniza cu Regulamentul intern al AJOFM Sibiu.<\/span><\/span><\/p>\n<p class=\"MsoNormal\" style=\"text-align:justify;background:white\"><span><b><span lang=\"RO\">Art.31 <\/span><\/b><\/span><span><span lang=\"RO\">Prezentul Cod de etic\u0103 \u015fi conduit\u0103 profesional\u0103 va fi<br \/>\nmodificat \u00een termen de 10 zile de la data modific\u0103rii actelor normative care<br \/>\nstau la baza acestuia sau ori de c\u00e2te ori se impune.<\/span><\/span><\/p>\n<p class=\"MsoNormal\" style=\"text-align:justify;background:white\"><span><b><span lang=\"RO\">Art.32<\/span><\/b><\/span><span><span lang=\"RO\"> Prezentul Cod de etic\u0103 \u015fi conduit\u0103 profesional\u0103 al<br \/>\npersonalului din cadrul AJOFM Sibiu, intr\u0103 \u00een vigoare la data aprob\u0103rii<br \/>\nacestuia, prin Decizia directorului executiv al AJOFM Sibiu.<\/span><\/span><\/p>\n<p class=\"MsoNormal\" style=\"text-align:justify;background:white\"><span><span lang=\"RO\">\u00a0<\/span><\/span><\/p>\n<p class=\"MsoNormal\" style=\"text-align:justify;background:white\"><span><b><span lang=\"RO\">Asigurarea publicit\u0103\u0163ii<\/span><\/b><\/span><\/p>\n<p class=\"MsoNormal\" style=\"text-align:justify;background:white\"><span><span lang=\"RO\">\u00a0<\/span><\/span><\/p>\n<p class=\"MsoNormal\" style=\"text-align:justify;background:white\"><span><b><span lang=\"RO\">Art.33 Prezentul Cod de etic\u0103 \u015fi conduit\u0103 profesional\u0103 va fi<br \/>\nrespectat, obligatoriu, de c\u0103tre to\u0163i angaja\u0163ii AJOFM SIBIU, se va aduce la<br \/>\ncuno\u015ftin\u0163a salaria\u0163ilor, pe baz\u0103 de semn\u0103tur\u0103, iar pentru informarea<br \/>\ncet\u0103\u0163enilor, Compartimentul Resurse umane, salarizare, comunicare \u015fi<br \/>\nsecretariatul Consiliului Consultativ are obliga\u0163ia de a afi\u015fa Codul de etic\u0103<br \/>\n\u015fi conduit\u0103 profesional\u0103 la sediul AJOFM Sibiu, \u00eentr-un loc vizibil, iar<br \/>\nCompartimentul Monitorizare proiecte finan\u0163ate din FSE, informatic\u0103 \u015fi<br \/>\nmanagementul bazelor de date \u00eel va posta pe site-ul AJOFM
