{"id":2804,"date":"2018-11-16T01:00:00","date_gmt":"2018-11-15T22:00:00","guid":{"rendered":"https:\/\/www.anofm.ro\/bucuresti\/informatii-generale-privind-economia-sociala\/"},"modified":"2025-08-27T10:09:59","modified_gmt":"2025-08-27T07:09:59","slug":"informatii-generale-privind-economia-sociala","status":"publish","type":"post","link":"https:\/\/www.anofm.ro\/bucuresti\/informatii-generale-privind-economia-sociala\/","title":{"rendered":"Informatii generale privind economia sociala"},"content":{"rendered":"<div>\n<p>Economia social\u0103 este reglementat\u0103 de <a href=\"https:\/\/www.anofm.ro\/wp-content\/uploads\/2025\/07\/LEGE-A-219-23-07-2015.pdf\">Legea nr. 219\/2015 privind economia social\u0103 cu modific\u0103rile si complet\u0103rile ulterioare<\/a>, publicat\u0103 \u00een Monitorul Oficial, Partea I, nr. 561 din 28 iulie 2015 ale c\u0103rei <a href=\"https:\/\/www.anofm.ro\/wp-content\/uploads\/2025\/08\/NORME-METODOLOGICE-de-aplicare-a-prevederilor-Legii-nr.-219_2015-privind-economia-sociala.pdf\">Norme metodologice<\/a> (vezi si <a href=\"https:\/\/www.anofm.ro\/legislatie-privind-economia-sociala\/\">Anexe ale normelor metodologice<\/a>) au fost adoptate prin HG nr. 585\/10.08.2016, publicate \u00een Monitorul Oficial, Partea I, nr. 660 din 29 august 2016, cu modific\u0103rile \u0219i complet\u0103rile ulterioare (HG. nr. 876\/15.07.2022; HG nr. 128\/15.02.2023).<\/p>\n<p>Conform Legii 219\/2015 cu modific\u0103rile si complet\u0103rile ulterioare, economia social\u0103 este definit\u0103 ca (art. 2 alin.1 din Lege) ansamblul activit\u0103\u0163ilor private cu caracter economic si social, servind interesul general, interesele unei colectivit\u0103\u021bi si\/sau interesele personale nepatrimoniale, prin cre\u0219terea incluziunii sociale si \/sau &#8211; furnizarea de bunuri, prestarea de servicii \u015fi\/sau execu\u0163ia de lucr\u0103ri.<\/p>\n<p>Economia social\u0103 are la baz\u0103 (art. 2 alin. 2 din Lege):<\/p>\n<p>1. Ini\u021biativa privat\u0103, voluntar\u0103 \u0219i solidar\u0103;<\/p>\n<p>2. Grad ridicat de autonomie \u0219i responsabilitate;<\/p>\n<p>3. Distribuirea limitat\u0103 a profitului sau excedentului, dup\u0103 caz, c\u0103tre asocia\u021bi sau membri.<\/p>\n<p>Principiile care stau la baza economiei sociale (art. 4 din Lege):<\/p>\n<p>1. prioritate acordat\u0103 individului \u015fi obiectivelor sociale fa\u0163\u0103 de cre\u015fterea profitului;<\/p>\n<p>2. solidaritate \u015fi responsabilitate colectiv\u0103;<\/p>\n<p>3. convergen\u0163a dintre interesele membrilor asocia\u0163i \u015fi interesul general \u015fi\/sau interesele unei colectivit\u0103\u0163i;<\/p>\n<p>4. control democratic al membrilor, exercitat asupra activit\u0103\u0163ilor desf\u0103\u015furate;<\/p>\n<p>5. caracter voluntar \u015fi liber al asocierii \u00een formele de organizare specifice domeniului economiei sociale;<\/p>\n<p>6. personalitate juridic\u0103 distinct\u0103, autonomie de gestiune \u015fi independen\u0163\u0103 fa\u0163\u0103 de autorit\u0103\u0163ile publice;<\/p>\n<p>7. alocarea celei mai mari p\u0103r\u0163i a profitului\/excedentului financiar pentru atingerea obiectivelor de interes general, ale unei colectivit\u0103\u0163i sau \u00een interesul personal nepatrimonial al membrilor;<\/p>\n<p>8. proces decizional transparent \u0219i responsabil \u00een interesul colectivit\u0103\u021bii pe care o deserve\u0219te.<\/p>\n<p>Economia social\u0103 contribuie la dezvoltarea comunit\u0103\u0163ilor locale, crearea de locuri de munc\u0103, dezvoltarea incluziunii \u0219i coeziunii sociale, tranzi\u021bia c\u0103tre economia circular\u0103 \u0219i inovarea social\u0103, implicarea persoanelor apar\u0163in\u00e2nd <a href=\"\/upload\/8\/Grup_vulnerabil_tabel.pdf\">grupului vulnerabil<\/a>, prev\u0103zut de lege, \u00een activit\u0103\u0163i cu caracter social \u015fi\/sau activit\u0103\u0163i economice, facilit\u00e2nd accesul acestora la resursele \u015fi serviciile comunit\u0103\u0163ii. (art. 5 alin. 1 din Lege).<\/p>\n<p>Obiectivele economiei sociale (art. 5 alin. 2 din Lege) sunt:<\/p>\n<p>1. consolidarea coeziunii economice \u015fi sociale;<\/p>\n<p>2. ocuparea for\u0163ei de munc\u0103;<\/p>\n<p>3. dezvoltarea serviciilor sociale.<\/p>\n<p>Activit\u0103\u021bi de interes general ale entit\u0103\u021bilor de economie social\u0103 &#8211;<\/p>\n<p>1. producerea de bunuri, prestarea de servicii \u015fi\/sau execu\u0163ia de lucr\u0103ri care contribuie la bun\u0103starea comunit\u0103\u0163ii sau a membrilor acesteia;<\/p>\n<p>2. promovarea, cu prioritate, a unor activit\u0103\u0163i care pot genera sau asigura locuri de munc\u0103 pentru \u00eencadrarea persoanelor apar\u0163in\u00e2nd grupului vulnerabil;<\/p>\n<p>3. dezvoltarea unor programe de formare profesional\u0103 dedicate persoanelor din grupul vulnerabil;<\/p>\n<p>4. dezvoltarea serviciilor sociale pentru cre\u015fterea capacit\u0103\u0163ii de inser\u0163ie pe pia\u0163a muncii a persoanelor din grupul vulnerabil.<\/p>\n<p>Entit\u0103\u021bile de economie sociale sunt reprezentate de:<\/p>\n<p>\u2022 \u00eentreprinderea social\u0103;<\/p>\n<p>\u2022 \u00eentreprinderea social\u0103 de inser\u021bie.<\/p>\n<p>\u00centreprinderea social\u0103 este persoana juridic\u0103 de drept privat care desf\u0103\u015foar\u0103 activit\u0103\u0163i \u00een domeniul economiei sociale, care de\u0163ine un atestat de \u00eentreprindere social\u0103 \u015fi respect\u0103 principiile economiei sociale.<\/p>\n<p>Atestatul se elibereaz\u0103 de c\u0103tre agen\u0163ia jude\u0163ean\u0103 pentru ocuparea for\u0163ei de munc\u0103, respectiv a municipiului Bucure\u015fti, prin compartimentul pentru economie social\u0103 (art. 8 alin. 5 din Lege). Atestatul se acord\u0103 pe o perioad\u0103 de 5 ani, cu posibilitatea prelungirii, dac\u0103 se face dovada c\u0103 sunt respectate condi\u0163iile care au stat la baza acord\u0103rii acestuia (art. 8 alin. 6 din Lege).<\/p>\n<p>\u00centreprinderea social\u0103 atestat\u0103 poate renun\u021ba la acest statut prin notificarea agen\u021biei pentru ocuparea for\u021bei de munc\u0103.<\/p>\n<p>Autorit\u0103\u0163ile administra\u0163iei publice centrale \u015fi locale sprijin\u0103 activit\u0103\u0163ile de economie social\u0103 prin (art. 7 din Lege):<\/p>\n<p>&#8211; recunoa\u015fterea rolului \u00eentreprinderilor sociale prin acordarea atestatului de \u00eentreprindere social\u0103;<\/p>\n<p>&#8211; recunoa\u015fterea rolului \u00eentreprinderilor sociale de inser\u0163ie prin acordarea m\u0103rcii sociale;<\/p>\n<p>&#8211; dezvoltarea mecanismelor de sprijinire a \u00eentreprinderilor sociale \u0219i a \u00eentreprinderilor sociale de inser\u0163ie;<\/p>\n<p>&#8211; promovarea \u015fi sus\u0163inerea dezvolt\u0103rii resurselor umane din domeniul economiei sociale;<\/p>\n<p>&#8211; participarea la activit\u0103\u0163i de economie social\u0103 prin colaborare \u00een diferite forme, potrivit legii;<\/p>\n<p>&#8211; \u00eenfiin\u0163area de centre de informare \u015fi consiliere \u00een domeniul economiei sociale;<\/p>\n<p>&#8211; facilitarea accesului \u00eentreprinderilor sociale \u0219i \u00eentreprinderilor sociale de inser\u021bie la t\u00e2rguri de profil sau t\u00e2rguri comerciale organizate de institu\u021biile publice \u00een \u021bar\u0103, prin scutirea de taxe de participare.<\/p>\n<p>Criterii pe care trebuie s\u0103 le prevad\u0103 \u0219i respecte \u00eentreprinderea social\u0103, prin actele de \u00eenfiin\u021bare \u0219i func\u021bionare (art. 8 alin. 4 din Lege):<\/p>\n<p>1. ac\u0163ioneaz\u0103 \u00een scop social \u015fi\/sau \u00een interesul general al comunit\u0103\u0163ii;<\/p>\n<p>2. aloc\u0103 minimum 90% din profitul\/excedentul realizat scopului social \u015fi rezervei statutare;<\/p>\n<p>3. se oblig\u0103 s\u0103 transmit\u0103 bunurile r\u0103mase \u00een urma lichid\u0103rii c\u0103tre una sau mai multe \u00eentreprinderi sociale;<\/p>\n<p>4. aplic\u0103 principiul echit\u0103\u0163ii sociale fa\u0163\u0103 de angaja\u0163i si administratori, asigur\u00e2nd niveluri de salarizare\/remunerare echitabile, \u00eentre care nu pot exista diferen\u0163e care s\u0103 dep\u0103\u015feasc\u0103 raportul de 1 la 8.<\/p>\n<p>\u00centreprinderea social\u0103 de inser\u021bie este \u00eentreprinderea care \u00eendepline\u015fte cumulativ urm\u0103toarele condi\u0163ii:<\/p>\n<p>1. are cel pu\u0163in 30% din personalul angajat sau membrii cooperatori apar\u0163in\u00e2nd grupului vulnerabil, astfel \u00eenc\u00e2t timpul de lucru cumulat al acestor angaja\u0163i s\u0103 reprezinte cel pu\u0163in 30% din totalul timpului de lucru al tuturor angaja\u0163ilor;<\/p>\n<p>2. are ca scop lupta \u00eempotriva excluziunii, discrimin\u0103rilor \u015fi \u015fomajului prin inser\u0163ia socioprofesional\u0103 a persoanelor defavorizate (art. 10 alin. 1 din Lege).<\/p>\n<p>Statutul de \u00eentreprindere social\u0103 de inser\u021bie se certific\u0103 prin acordarea m\u0103rcii sociale.<\/p>\n<p>Marca social\u0103 cuprinde certificatul care atest\u0103 statutul de \u00eentreprindere social\u0103 de inser\u0163ie, cu o valabilitate de 3 ani de la data emiterii, precum \u015fi un element specific de identitate vizual\u0103, care se aplic\u0103 \u00een mod obligatoriu asupra produselor realizate sau a lucr\u0103rilor executate ori a documentelor care demonstreaz\u0103 prestarea unui serviciu (art. 13 alin. 1 din Lege).<\/p>\n<p><span style=\"font-size: revert;text-align: justify\">Conform Legii 219\/2015, economia social\u0103 este definit\u0103 ca (art. 2 alin.1 din Lege) ansamblul activit\u0103\u0163ilor organizate independent de sectorul public, al c\u0103ror scop este s\u0103 serveasc\u0103 interesul general, interesele unei colectivit\u0103\u0163i \u015fi\/sau interesele personale nepatrimoniale, prin cre\u015fterea gradului de ocupare a persoanelor apar\u0163in\u00e2nd grupului vulnerabil \u015fi\/sau producerea \u015fi furnizarea de bunuri, prestarea de servicii \u015fi\/sau execu\u0163ia de lucr\u0103ri.<\/span><\/p>\n<\/div>\n<p><span style=\"line-height: 115%\"><span style=\"font-size: 14px\"><b>Economia social\u0103 are la baz\u0103<\/b> (art. 2 alin. 2 din Lege):<\/span><\/span><\/p>\n<p class=\"MsoListParagraphCxSpFirst\" style=\"margin-left: 18.0pt;text-align: justify;text-indent: -18.0pt\"><span style=\"font-size: 14px\"><span style=\"line-height: 115%\">\u00a0 \u00a0 \u00a0 \u00a0 \u00a01. <\/span><span style=\"line-height: 115%\">Ini\u021biativa privat\u0103, voluntar\u0103 \u0219i solidar\u0103;<br \/>\n<\/span><\/span><span style=\"font-size: 14px;text-indent: -18pt;line-height: 115%\">\u00a0 \u00a02. <\/span><span style=\"font-size: 14px;text-indent: -18pt;line-height: 115%\">Grad ridicat de autonomie \u0219i responsabilitate;<br \/>\n<\/span><span style=\"font-size: 14px;text-indent: -18pt;line-height: 115%\">\u00a0 \u00a03. <\/span><span style=\"font-size: 14px;text-indent: 115%\">control democratic al membrilor, exercitat asupra activit\u0103\u0163ilor desf\u0103\u015furate;<br \/>\n<\/span><span style=\"font-size: 14px;text-indent: -18pt;line-height: 115%\">\u00a0 \u00a05.<\/span><span style=\"font-size: 14px;text-indent: -18pt;line-height: 115%\">caracter voluntar \u015fi liber al asocierii \u00een formele de organizare specifice domeniului economiei<br \/>\nsociale;<br \/>\n<\/span><span style=\"font-size: 14px;text-indent: -18pt;line-height: 115%\">\u00a0 \u00a06.<\/span><span style=\"font-size: 14px;text-indent: -18pt;line-height: 115%\">personalitate juridic\u0103 distinct\u0103, autonomie de gestiune \u015fi independen\u0163\u0103 fa\u0163\u0103 de autorit\u0103\u0163ile<br \/>\npublice;<br \/>\n<\/span><span style=\"font-size: 14px;text-indent: -18pt;line-height: 115%\">\u00a0 \u00a07.<\/span><span style=\"font-size: 14px;text-indent: -18pt;line-height: 115%\">a<\/span><span style=\"font-size: 14px;text-indent: -18pt;line-height: 115%\">locarea celei mai mari p\u0103r\u0163i a profitului\/excedentului financiar pentru atingerea obiectivelor de interes general, ale unei colectivit\u0103\u0163i sau \u00een interesul personal nepatrimonial al membrilor.<\/span><\/p>\n<p class=\"MsoNormal\"><span style=\"line-height: 115%\"><span style=\"font-size: 14px\">Economia social\u0103 contribuie la dezvoltarea comunit\u0103\u0163ilor locale, crearea de locuri de munc\u0103, implicarea persoanelor apar\u0163in\u00e2nd <a href=\"https:\/\/www.anofm.ro\/wp-content\/uploads\/2025\/07\/grup-vulnerabil-tabel.pdf\">grupului vulnerabil<\/a>, prev\u0103zut de prezenta lege, \u00een activit\u0103\u0163i cu caracter social \u015fi\/sau activit\u0103\u0163i economice, facilit\u00e2nd accesul acestora la resursele \u015fi serviciile comunit\u0103\u0163ii. (art. 5 alin. 1 din Lege). <\/span><\/span><\/p>\n<p><span style=\"line-height: 115%\"><span style=\"font-size: 14px\"><b>Obiectivele economiei sociale<\/b> (art. 5 alin. 2 din Lege) sunt:<\/span><\/span><\/p>\n<p class=\"MsoListParagraphCxSpFirst\" style=\"text-align: justify;text-indent: -18.0pt\"><span style=\"font-size: 14px\"><span style=\"line-height: 115%\">\u00a0 \u00a0 \u00a0<span style=\"font-size: 14px;font-family: Trebuchet MS\"><span style=\"font-style: normal;font-variant: normal;font-weight: normal;line-height: normal\">\u00a0 \u00a0 \u00a0 \u00a0 \u00a0<\/span><span style=\"font-style: normal;font-variant: normal;font-weight: normal;line-height: normal\">1.c<\/span><\/span><\/span><span style=\"line-height: 115%\"><span style=\"font-size: 14px;font-family: Trebuchet MS\">onsolidarea coeziunii economice \u015fi sociale;<\/span><span style=\"font-size: 14px;font-family: Trebuchet MS\"><br \/>\n<\/span><\/span><\/span><span style=\"font-size: 14px\"><span style=\"line-height: normal\">\u00a0 \u00a0 \u00a0 \u00a0 \u00a02.o<\/span><\/span><span style=\"font-size: 14px\">cuparea for\u0163ei de munc\u0103;<br \/>\n<\/span><span style=\"font-size: 14px\"><span style=\"line-height: normal\">\u00a0 \u00a0 \u00a0 \u00a0 \u00a03.<\/span><\/span><span style=\"font-size: 14px\">dezvoltarea serviciilor sociale.<\/span><\/p>\n<p class=\"MsoNormal\" style=\"text-align: justify\"><span style=\"line-height: 115%\"><span style=\"font-size: 14px;font-family: Trebuchet MS\"><b>Activit\u0103\u021bi de interes general ale entit\u0103\u021bilor de economie socal\u0103<\/b> (art. 5 alin. 3 din Lege):<\/span><\/span><\/p>\n<p class=\"MsoListParagraphCxSpFirst\" style=\"text-align: justify;text-indent: -18pt;margin-left: 40px\"><span style=\"font-size: 14px;font-family: Trebuchet MS\"><span style=\"line-height: 115%\"><span style=\"font-style: normal;font-variant: normal;font-weight: normal;line-height: normal\"><span style=\"font-size: 14px\">\u00a0 \u00a0<\/span><span style=\"font-size: 14px\">1.p<\/span><\/span><\/span><span style=\"line-height: 115%\"><span style=\"font-size: 14px\">roducerea de bunuri, prestarea de servicii \u015fi\/sau execu\u0163ia de lucr\u0103ri care contribuie la bun\u0103starea comunit\u0103\u0163ii sau a membrilor acesteia;<\/span><\/span><\/span><span style=\"font-size: 14px\">\u00a0<\/span><span style=\"font-size: 14px\"><br \/>\n<\/span><span style=\"font-size: 14px;font-family: Trebuchet MS\"><span style=\"text-indent: -18pt;line-height: 115%\"><span style=\"line-height: normal\">2.p<\/span><\/span><span style=\"text-indent: -18pt;line-height: 115%\">romovarea, cu prioritate, a unor activit\u0103\u0163i care pot genera sau asigura locuri de munc\u0103 pentru \u00eencadrarea persoanelor apar\u0163in\u00e2nd grupului vulnerabil;<br \/>\n<\/span><span style=\"text-indent: -18pt;line-height: 115%\"><span style=\"line-height: normal\">3.d<\/span><\/span><\/span><span style=\"font-size: 14px\">ezvoltarea unor programe de formare profesional\u0103 dedicate persoanelor din grupul vulnerabil;<br \/>\n<\/span><span style=\"font-size: 14px\"><span style=\"line-height: normal\">4.<\/span><\/span><span style=\"font-size: 14px\">dezvoltarea serviciilor sociale pentru cre\u015fterea capacit\u0103\u0163ii de inser\u0163ie pe pia\u0163a muncii a<br \/>\npersoanelor din grupul vulnerabil.<\/span><\/p>\n<p>Entit\u0103\u021bile de economie sociale\u00a0<b style=\"font-family: sans-serif;font-size: 12px\"><span style=\"font-size: 14px;font-family: Trebuchet MS\">sunt reprezentate de:<\/span><\/b><\/p>\n<ul>\n<li>\u00eentreprinderea social\u0103;<\/li>\n<li>\u00eentreprinderea social\u0103 de inser\u021bie.<\/li>\n<\/ul>\n<p><span style=\"font-size: 14px;font-family: Trebuchet MS\"><a href=\"\/upload\/1982\/4-IS.jpg\"><strong><span lang=\"EN-US\" style=\"line-height: 115%\">\u00centreprinderea social\u0103<\/span><\/strong><\/a><span lang=\"EN-US\" style=\"line-height: 115%\"> este persoana juridic\u0103 de drept privat care desf\u0103\u015foar\u0103 activit\u0103\u0163i \u00een domeniul economiei sociale, care de\u0163ine un atestat de \u00eentreprindere social\u0103 \u015fi respect\u0103 principiile economiei sociale.<\/span><\/span><\/p>\n<p class=\"MsoNormal\" style=\"text-align: justify\"><span style=\"line-height: 115%\"><span style=\"font-size: 14px;font-family: Trebuchet MS\"><b>Atestatul <\/b>se elibereaz\u0103 de c\u0103tre agen\u0163ia jude\u0163ean\u0103 pentru ocuparea for\u0163ei de munc\u0103, respectiv a municipiului Bucure\u015fti, prin compartimentul pentru economie social\u0103 (art. 8 alin. 5 din Lege).\u00a0<\/span><\/span><span style=\"font-size: 14px\">Atestatul se acord\u0103 pe o perioad\u0103 de 5 ani, cu posibilitatea \u00eentreprindere social\u0103;<\/span><\/span><\/span><span style=\"font-size: 14px;font-family: Trebuchet MS\"><span style=\"text-indent: -18pt;font-size: 14px;font-family: Trebuchet MS\"><span style=\"line-height: 115%\"><br \/>\n<\/span><\/span><\/span><span style=\"text-indent: -18pt;font-size: 14px\">&#8211; recunoa\u015fterea rolului \u00eentreprinderilor sociale de inser\u0163ie prin valabilitate de 3 ani de la data emiterii, \u00a0precum \u015fi un element specific de identitate vizual\u0103, care se aplic\u0103 \u00een mod obligatoriu asupra produselor realizate sau a lucr\u0103rilor executate ori a documentelor care demonstreaz\u0103 prestarea unui serviciu (art. 13 alin. 1 din Lege).<\/span><\/span><\/p>\n<p><span style=\"font-size:
