(4) din OUG nr. 132\/2020 \u2013 reducere timp munc\u0103<\/span><\/span><span style=\"font-weight: bolder\"><span lang=\"EN-US\"><\/span><\/span><\/p>\n<p style=\"margin-top: 0px;margin-bottom: 1rem;font-family: -apple-system, BlinkMacSystemFont,\"><span style=\"font-weight: bolder\"><span style=\"font-weight: normal\">\u00cen cazul reducerii temporare a activit\u0103\u0163ii determinate\u00a0 de\u00a0 instituirea\u00a0 st\u0103rii\u00a0 de\u00a0 urgen\u0163\u0103\/alert\u0103\/asediu,\u00a0 \u00een\u00a0 condi\u0163iile\u00a0 legii,\u00a0 angajatorii\u00a0 au posibilitatea reducerii timpului de munc\u0103 a salaria\u0163ilor cu cel mult 50% din durata prev\u0103zut\u0103 \u00een contractul\u00a0 individual\u00a0 de\u00a0 munc\u0103,\u00a0 cu\u00a0 informarea\u00a0 \u015fi\u00a0 consultarea\u00a0 sindicatului,\u00a0 a\u00a0 reprezentan\u0163ilor salaria\u0163ilor sau a salaria\u0163ilor, dup\u0103 caz, anterior comunic\u0103rii deciziei salariatului.<br \/>Reducerea timpului de munc\u0103 se stabile\u015fte prin decizia angajatorului, pentru o perioad\u0103 de cel pu\u0163in 5 zile lucr\u0103toare consecutive, angajatorul av\u00e2nd obliga\u0163ia de stabilire a programului de munc\u0103 pentru \u00eentreaga lun\u0103.<br \/>Pe\u00a0 durata\u00a0 reducerii\u00a0 timpului\u00a0 de\u00a0 munc\u0103\u00a0 salaria\u0163ii afecta\u0163i de m\u0103sur\u0103 beneficiaz\u0103 de o indemniza\u0163ie de 75% din diferen\u0163a dintre salariul de baz\u0103 brut prev\u0103zut \u00een contractul individual de munc\u0103 \u015fi salariul de baz\u0103 brut aferent orelor de munc\u0103 efectiv\u00a0 prestate\u00a0 ca\u00a0 urmare\u00a0 a\u00a0 reducerii\u00a0 timpului de munc\u0103, \u00een completarea drepturilor salariale cuvenite, calculate la timpul efectiv lucrat.<br \/>Indemniza\u0163ia de mai sus este suportat\u0103 de angajator \u015fi se achit\u0103 la data pl\u0103\u0163ii salariului\u00a0 aferent\u00a0 lunii\u00a0 respective,\u00a0 urm\u00e2nd\u00a0 a\u00a0 se\u00a0 deconta\u00a0 din\u00a0 bugetul asigur\u0103rilor pentru \u015fomaj dup\u0103 \u00eendeplinirea de c\u0103tre angajator a obliga\u0163iilor declarative \u015fi de plat\u0103 aferente veniturilor din salarii\u00a0 \u015fi\u00a0 asimilate\u00a0 salariilor\u00a0 din\u00a0 perioada\u00a0 pentru\u00a0 care\u00a0 se\u00a0 face\u00a0 solicitarea\u00a0 \u00een\u00a0 conformitate\u00a0 cu prevederile\u00a0 Legii\u00a0 nr.\u00a0 227\/2015\u00a0 privind\u00a0 Codul\u00a0 fiscal.<\/span><br \/><\/span><\/p>\n<p><span lang=\"EN-US\" style=\"font-family: -apple-system, BlinkMacSystemFont,\"><\/span><\/p>\n<p style=\"margin-top: 0px;margin-bottom: 1rem;font-family: -apple-system, BlinkMacSystemFont,\">\n<p class=\"MsoNormal\" style=\"margin-top: 0px;margin-bottom: 1rem;font-family: -apple-system, BlinkMacSystemFont,\"><span lang=\"EN-US\">Documentele necesare angajatorilor pentru decontarea indemniza\u021biei prev\u0103zut\u0103 de Art. 1 alin (4) din OUG nr. 132\/2020 au fost aprobate prin Ordinul Ministrului Muncii \u0219i Protec\u021biei Sociale nr. 1393\/15.09.2020, publicat \u00een Monitorul Oficial nr. 850\/16.09.2020.
